A variance under the Clean Water Act, is the NPDES permit system
issued by the state. It results in this Certificate of Coverage.
Circuit Court Judge Murphy has ruled that Merit exceeded it's COC, by not having
a seperate permit for brines and chlorides.
Under the Clean Water Act.... a discharge shall not cause degredation. The brines
and chlorides in this discharge are below human contamination levels, but would
cause significant damage to the stream ecology.... Judge Murphy already has
ruled on the environmental MEPA case prior, in which we proved damage to the
resource from this discharge.... the 13 day trial.

Court is scheduled in Gaylord, 8:30, Otsego County Court Room,
to hear an administrative appeal of the Administrative Law Judge decision on
certificate of coverage. This will be the first Judge Murphy has seen of this
contested case hearing results. All are welcome to attend.
